Who is the Defendant? Is there More than One? Then You Must Identify Them All
As we’ve already said, in a personal injury lawsuit as a result of a car accident, you, the plaintiff, can claim anything you want. All the defendant has to do is say “prove it.” If you don’t, the defendant wins.
In many instances, it might not be entirely clear from the outset who was to blame for your injuries. In some cases, this is because the actions that ultimately led to your injuries may have happened long before those injuries occurred. For example, if you were involved in a car accident because there was a mattress in the middle of the road, the car or truck that was hauling the mattress may be 50 miles down the highway by the time you hit that mattress with your vehicle. In other cases, so many parties may have been involved in the events leading up to your accident that it can be difficult to sort everything out and precisely know which one (or ones) was negligent. It’s always possible that several share the blame. And when multiple individuals cause an accident all can be named as defendants. In any event, a thorough investigation conducted by an experienced personal injury lawyer can usually identify the source (or sources) of your injuries.
Besides the importance of conducting an investigation, there’s one other key thing to know about defendants. You must file a lawsuit against a solvent defendant: a person or entity with enough money to pay you damages, especially if they might not have a liability insurer. If a defendant is insolvent you won’t be successful in collecting the full amount, or any amount, of the damages, whether you’re able to prove that he’s liable or not. This is a sad circumstance, but one that unfortunately does occur.
Defendants know that if they can appear “poor,” they won’t be required to compensate an accident victim for injuries the defendant caused them. Many defendants can go to great lengths to hide their assets and appear insolvent, even when they’re not. at our Law Offices, we perform thorough asset checks of all defendants and know all the tricks they try to hide their assets. We create a clear picture of all their available resources: cash or liquidated equity. If the defendant in your case is hiding something, you can bet that we’ll find it.
Put our years of experience to work for you if you want to know what your rights are, how to proceed with your claim, and how much compensation you can win from your personal injury case. Regardless of how it happened, we’ll answer all of your questions. Call our Law Firm now for a free consultation and find out how we can help you.

Be Careful of Speeding Tick Myths and Urban Legends!
There are several speeding ticket myths and urban legends that continue to misguide many drivers. Many drivers have succumbed to these speeding ticket myths and mounted charges against them. The consequences can be disastrous financially.
There are legitimate ways of fighting and beating speeding tickets. But the speeding ticket myths below are NOT those ways. Don’t risk your defense by using one of these myths.
Don’t Fall for Any of These Speeding Ticket Myths and Urban Legends. Remember, these speeding ticket myths and urban legends do not work!
Traffic Ticket
A vector illustration of a policeman giving a driver a traffic violation ticket
Myth #1: The Officer Made a Mistake; the Speeding Ticket Should Be Dismissed
“The officer made a mistake and didn’t write down the correct information. My ticket should be dismissed.”
This myth will not work because judges allow reasonable errors by officers. If the officer wrote that you drove a blue Honda and it was a red Honda, the judge will allow the error. After all, if it was mistaken, how did you end up with the ticket? The judge will not dismiss your ticket based on a slight technicality like that.
Myth #2: Overpay the Speeding Ticket, Don’t Cash Out Refund, Off the Record
“If you overpay the speeding ticket the courts must refund you the balance. When you get the refund check, don’t cash it. This will leave the transaction incomplete and you will not have the speeding ticket on your record.”
This myth has circulated the web, in email forwards, in forums, and many other places. The truth is that this is simply not true. You cannot fight or beat a speeding ticket based on not cashing a refund check.
First of all, once a judge pronounces you guilty, the violation is entered into the records. The speeding ticket becomes a part of your record and points are assessed.
Second, basic accounting can quickly show that this line of thinking is preposterous. If we try to follow the logic of this myth, it breaks down when compared to accounting principles. A commissioned refund check requires proof of transaction. A refund check is assessed when the transaction is already completed.
Think of it as a store refunding your purchase. You need a store receipt, and proof of transaction, to receive a refund. So, in this case, whether you cash the refund check or not, since a check was issued the transaction is complete and the speeding ticket is on your record.
Myth #3: Have Police Association Stickers on the Car & Avoid Speeding Ticket
“If you have police association stickers on your car, the officer will know you’re a cop and not write you a ticket.”
Police officers have a fraternal bond as civil servants, but they also respect each other’s jobs and authority. Legitimate retired or active police officers will hand over a police ID. Only as a courtesy, the police officer will not issue a speeding ticket.
Using stickers will not help you and chances are, you are not the first person the officer has encountered who has tried this “trick”.
The only real “trick” is a solid legal defense.
Myth #4: Pull Tricks to Postpone Your Traffic Speeding Court Date
“You can postpone your speeding ticket court date to a day that the police officer is on vacation. If he doesn’t show up, the case is dismissed.”
Unless grace and favor are upon you, chances are you will not be lucky enough to postpone your speeding ticket trial date to a day that the officer is on vacation. And NO police department will give out the vacation schedule of their police officers! Chances are, if you request such information, you will raise their suspicions about you.
Also, if you postpone your traffic speeding ticket court trial to a day that the officer does not or cannot show up, the prosecutor can easily move the trial date to another time. After all, moving the court date worked for you so it certainly will work for them.
Once again, the best defense for fighting a speeding ticket is to have a solid legal defense.

Personal Injury Lawyers: Proving Property Owner Negligence
How to Show, or Prove, the Negligence of a Property Owner in Relation to a Premises Liability Case
Did You Know?
Our attorneys have been fighting for victims` rights for over 20 years. Call to discuss your case.
Our city is a very dynamic metropolis with numerous shopping centers and restaurants featuring some of the best food in the state. With all of these varying types of properties, the different types of injuries you may suffer are vast and the odds of you being injured are increased. If you suffer an injury due to the negligence of another person, the property owner may be responsible for your damages.
How Do We Prove The Property Owner Was Negligent?
There are various ways in which we can prove that the property owner was negligent. If you were a trespasser and injured on another person’s property we may be able to establish that the property owner intentionally concealed a defect that hurt you. If the property owner knew that you would not be able to discover the harm, they should be found responsible for your resulting injuries.
If you were at a hotel would be considered an invitee and the property owner would be responsible for any negligence. There may be a very popular bar at the hotel and many patrons will frequently take drinks out of the bar and into the lobby area which has marble floors. If someone spills their drink, the floor would become incredibly slick and you could easily slip and fall.
It is the property owner’s responsibility to regularly inspect the premises for dangerous conditions and is required to remove them to protect you. Essentially, we can prove negligence in this situation by establishing that the water was spilled, the property owner failed to clean it up, and when you slipped on the wet floor you were classified as an invitee. Therefore, a large part of proving the property owner was negligent is proving that you were first owed a duty of care.
What Standard of Care Does the Property Owner Owe Me?
This question is incredibly complex. Simply put, the standard of care the property owes you is dependent upon your status as a visitor. You can be classified as a trespasser, licensee, or invitee. If you are a trespasser, you are wrongfully on the property and you are owed the least care.
While the property owner cannot intentionally cause you harm, they are not required to remove any known dangers that might hurt you. Property owners are simply required to warn any expected trespassers about dangers that are likely to harm the trespasser.
The duty owed to a licensee is very similar to that of a trespasser, but they are owed a slightly greater duty of care. Anytime you visit your friend’s house or venture onto your neighbor’s property to retrieve a personal item you are considered a licensee. Again, property owners are not required to repair any known dangers, they are simply expected to adequately warn the licensee about any hazards which they expect might harm the visitor.
Finally, invitees are owed the greatest standard of care. When you visit any type of grocery store, any restaurant, a shopping mall, or even your local office you are considered an invitee. Basically, you are an invitee anytime you are on a property solely for business purposes.attorneys
As an invitee, the property owner must do their best to remove any hazards on the property and are required to actively inspect the property for liabilities. If they fail to provide a safe premises it is likely that it was caused by the property owner’s negligence.
Do you have a legal issue or question? Contact us now.
Once our attorneys establish which status you were classified as at the time of your injury, we can then work to effectively prove that the property owner violated their duty of care and thus was negligent.

13 Steps to Take If An Injury Accident Occurs
Unfortunately, bad things do happen, no matter how careful we are. Read through these 13 steps now. If a car accident happens, you’ll know what to do.
1. Promptly notify the police and call for an ambulance if anyone is hurt.
2. Cooperate with the authorities who come to the scene.
3. Take reasonable steps to protect your vehicle from another loss. Consider moving it out of the flow of traffic.
4. Try to record everything on the scene. Your notes should include details of the accident, identification of the autos and people involved, and the names and badge numbers of all emergency personnel. Take pictures if possible.
5. Insist on breath tests if you suspect drugs or alcohol are involved.
6. Do not accept money. Do not accept fault. Do not agree to forget about the auto accident.
7. Get copies of all police reports.
8. Have the insurance company inspect and appraise the damage before any steps are taken to repair it.
9. Cooperate with the auto insurance carrier representative in the investigation, defense, or settlement.
10. Send your car insurance carrier copies of any notice or legal papers received in connection with the accident as soon as possible. Make sure you keep the originals.
11. If you are injured, submit to physical examinations by physicians selected by the insurance carrier as often as they reasonably require. (the insurance carrier pays the cost of these examinations.)
12. Give your authorization for the insurance carrier to obtain medical reports and other pertinent records.
13. File a claim.

MOTORCYCLE ACCIDENT ATTORNEYS
According to the US Department of Transportation’s motorcycle accident statistics and rates, a motorcyclist is 16 times more likely to die in an accident than a motor vehicle occupant. According to the same motorcycle accident statistics, motorcyclists are also three times more likely to be injured than people driving in cars. Over half of all motorcycles involved in fatal crashes collided with another motor vehicle in transit. Motorcycle accident statistics and rates show that one of the best ways to prevent severe injury or death is by using safety equipment such as helmets and defensive driving practices. More motorcycle accident statistics from the US DOT:
* Motorcycle accidents and injuries are more likely to occur at night-with an increased number of fatal crashes occurring after dark
(motorcycle accident statistics show that 60% of all fatalities happened at night).
* Nearly half of all motorcycle operators involved in fatal crashes were exceeding the speed limit
* Around 80% of all motorcycle accidents end in injury or death
* Motorcycle operators involved in fatal crashes had higher intoxication rates than drivers of any other type of vehicle involved in a
fatal accident.
These types of motorcycle accident statistics and rates can have a prejudicial effect on people and even influence the outcome of litigation and criminal proceedings. It is important to understand that motorcycle accident statistics are gathered from many accidents and that your specific motorcycle accident could completely contradict the impression created by motorcycle accident statistics and rates. An attorney with experience representing motorcyclists can help you review motorcycle accident statistics from various sources and explain how they can be used in your particular situation.
A motorcycle accident usually involves the motorcycle and another moving vehicle. In almost 75% of motorcycle accidents, the front of the motorcycle strikes the other vehicle. However, more than a quarter of motorcycle accidents are caused by the motorcycle crashing into a stationary object. Like other vehicular accidents, motorcycle accidents are much more likely when either driver is speeding or under the influence of alcohol. Motorcycle accidents can be prevented through defensive driving/riding. The number of motorcyclists involved in a fatal motorcycle accident while speeding was double that of drivers of other vehicles. Reducing motorcycle accidents’ frequency and severity can be as simple as observing posted speed limits. Another major factor in motorcycle accidents is vehicle blind spots. Motorcyclists who make their presence known can avoid motorcycle accidents caused by other drivers. A helmet can greatly reduce head and neck injuries if a motorcycle accident does occur.
The most important thing to do if you are involved in a motorcycle accident is to remain calm. If possible, get the contact information of everyone involved in the motorcycle accident. Exchange insurance information and review the police report if possible. Make sure the details of the motorcycle accident are included: weather, road conditions, number and types of vehicles, and even diagrams of the motorcycle accident can help insurance companies make the correct conclusions as to cause and fault. The injuries received in motorcycle accidents are generally much more severe than those from regular vehicular accidents. Motorcycle accidents can result in debilitating injuries and even death. If a motorcycle accident has affected your quality of life, or if a loved one has been severely injured or killed in a motorcycle accident, you may wish to speak to an attorney who is familiar with the legal aspects of motorcycle accidents. IF YOU OR A LOVED ONE HAS BEEN INJURED IN AN ACCIDENT, YOU NEED THE ADVICE OF AN EXPERIENCED PERSONAL INJURY LAWYER. CALL OUR LAW OFFICE TODAY FOR YOUR FREE CONSULTATION.

You Can Lose Your Driving Privileges With Too Many Points
Many states assign points to traffic violations that occur in their state. If you receive a speeding ticket, these points are placed on your driving record. These points can do several things for you, including:
Be placed on your driving record
Raise your auto insurance rates
Cause your driver’s license to be suspended or revoked.
If you receive a speeding ticket, you should first call the Justice of the Peace in the county where you received the speeding ticket if you are out of state. You may also call if you live in the state but not the county. You may call or go to the Justice of Peace’s office to handle your ticket if you live in the state and county. You can handle your speeding ticket before the day you’re supposed to appear in court.
You may also access a website to allow you to pay your speeding ticket. You can use the Public Safety website and the Interactive Voice Response System to pay your speeding ticket, but this will typically cause your ticket to go on your driving record.
Other options for dealing with your speeding ticket include deferred probation if you qualify for it. This will keep the ticket off of your record, but you will not be able to receive another ticket without it going on your driving record. You can also go to driving school or take Defensive Driving to handle your speeding ticket.
In most cases, you will not be required to appear in court if you have already handled the ticket in another fashion before your court date.
If you feel that you should fight your ticket in court, you will appear in court on the date set on your ticket. At this time, you will plead not guilty and request a trial date. If you need to change your appearance date, call the Court Clerk’s office or appear in person before the date to request that it be changed.
If you do not take any action to resolve your speeding ticket and do not appear in court, your information is sent to the Department of Public Safety, and your license will be suspended. An arrest warrant may also be issued, and additional fines on your license must be paid before it is reinstated. As you can see, you have many options to resolve your speeding ticket.

Advanced Techniques for Avoiding Traffic Tickets
Mastering advanced driving techniques can further enhance your ability to navigate the roads safely and avoid traffic tickets. Let’s delve into some advanced strategies that experienced drivers employ to minimize their risk of receiving citations.
1. Radar Detection Devices:
While the legality of radar detectors varies by location, where permitted, these devices can provide real-time alerts about speed traps and law enforcement presence. Be sure to check and adhere to local laws regarding their use.
2. Stay Informed About Traffic Patterns:
Understanding the flow of traffic on specific routes and during different times of the day can help you make informed decisions. Being aware of traffic patterns allows you to anticipate slowdowns, plan alternative routes, and avoid potential violations.
3. Utilize Carpool Lanes Legally:
Carpool or high-occupancy vehicle (HOV) lanes can be a time-saving option. Ensure you meet the occupancy requirements before using these lanes, as violating carpool lane rules can result in tickets.
4. Plan Your Speed:
Maintaining a steady, moderate speed can be more effective than constantly fluctuating between speeding and slowing down. Consistent driving helps you blend in with traffic and reduces the chances of attracting attention.
5. Know Where Traffic Cameras Are Located:
Familiarize yourself with the locations of traffic cameras in your area. Many cities use red-light cameras and speed cameras to enforce traffic laws. Being aware of these locations can help you adjust your driving behavior accordingly.
6. Use Legal Lane Filtering:
In some places, lane filtering or lane splitting is legal for motorcycles. Understand the laws in your area and, if permitted, use these techniques safely and legally.
7. Invest in Advanced Driver Assistance Systems (ADAS):
Many modern vehicles come equipped with ADAS, such as lane departure warnings, collision avoidance systems, and adaptive cruise control. These systems can enhance your driving safety and reduce the risk of accidents and tickets.
8. Develop Situational Awareness:
Stay vigilant and aware of your surroundings. Pay attention to other drivers, road signs, and potential hazards. Anticipating changes in traffic conditions allows you to make proactive decisions to avoid violations.
9. Watch Your Acceleration and Deceleration:
Sudden accelerations or decelerations can attract attention and may lead to traffic stops. Practice smooth driving habits to maintain a low profile on the road.
10. Join a Defensive Driving Course:
Beyond the basic defensive driving courses, consider more advanced defensive driving classes. These courses often provide insights into handling challenging driving situations and improving overall driving skills.
11. Choose a Low-Profile Vehicle:
High-performance or flashy vehicles may attract more attention from law enforcement. Opting for a low-profile vehicle in terms of appearance and performance can help you blend in with traffic.
12. Navigate Avoidance Routes:
GPS navigation apps often provide real-time traffic updates and suggest alternative routes to avoid congestion. Utilize these features to navigate around potential traffic stops.
13. Monitor Your Driving Record:
Regularly check your driving record for accuracy. Any inaccuracies or discrepancies should be addressed promptly to avoid potential issues during traffic stops.
By incorporating these advanced techniques into your driving habits, you can further reduce the likelihood of receiving traffic tickets. In the next article, we’ll explore the importance of maintaining a calm and respectful demeanor during traffic stops and the role it plays in influencing the outcome.

Prescription Drugs that Cause Birth Defects
An estimated 90% of women take one medication during pregnancy while 70% take at least one prescribed medicine. Over the last three decades, prescription medication use during the first trimester has increased by more than 60%. Research has shown that taking prescription pain killers can increase your child’s risk of birth defects. An average of 150,000 children are born with birth defects in the United States each year ranging from milk conditions to life-threatening. Heart defects are the most common form of a birth defect affecting more than 25,000 US infants each year. Clubfoot is the second most common defect affecting more than 5,000 babies per year. Down syndrome gives children a degree of retardation and impacts 1 in every 1,000 babies in America.
Drugs that Increase Risks of Birth Defects
1. Teratogenic: These medications can cause birth defects in multiple ways by directly damaging the fetus, damaging the placenta or umbilical cord, or causing uterine contractions.
2. Tetracyclines, Sulfa drug, Cipro, and other Antibiotics.
3. Benzodiazepines for sleeping pills and anti-anxiety drugs can contribute to issues with newborns breathing, temperature regulation, and muscle problems.
4. Accutane and other related dermatological drugs are known to pose an extremely serious risk of birth defects or death and should never be used by a pregnant woman.
5. Soriatane is another dermatological drug that is considered damaging to developing fetuses and is not recommended for use for three years prior to conception.
6. Aspirins and other related salicylates drugs can cause birth complications when used late in pregnancy.
7. Antidepressants such as Paxil can double the risk of heart birth defects when used in the first trimester. Prozac is known to double your risk for delivering a child with primary pulmonary hypertension.

Pedestrian Accident Lawyers
Pedestrians always have the right of way, this is a given and a law in just about, if not all states in the US. This is one reason that pedestrian accidents claims are so commonly won. If a person is walking across the street and he/she is hit by a car then typically the blame falls on the driver of the car, not the pedestrian. While there are some unfortunate circumstances in which an intoxicated person or perhaps even a mentally ill person may step off the curb offering very little time for the driver to act, this is not usually the case.
Today things like texting and social networking while driving a car are responsible for a number of pedestrian accidents. In these cases the drivers are without a doubt 100% wrong and should be held responsible for the accident. Unfortunately, there are some instances that occur with no witnesses and very little evidence to go on. These are the tough cases that require a competent group of attorneys to help sort out the issue and get to the bottom of what really occurred.
In addition, not all pedestrian accidents that happen even involve a car. Sometimes cases are municipal liability claims as a result of a manhole which has been left open, causing a pedestrian to fall in and become injured. There are many ways a pedestrian can be injured but one thing that most of these have in common is that there is almost always someone or some organization to blame for the accident.
If you know someone, either a loved one or if you yourself have been injured as a pedestrian then you have the right to seek compensation from the responsible party. You will need strong legal counsel and we at our law firm can provide that. Contact us to discuss your possible case and to get advice on how to proceed. We will bring you in for an appointment and let you state your case to one of our qualified attorneys who deals regularly with pedestrian accidents.
